Erisa, Health, Pension, Disability Litigation
We represent individuals who have been denied pension, health or disability benefits under plans governed by both state law and the Employee Retirement Income Security Act of 1974 (“ERISA”). We also represent classes of beneficiaries in lawsuits against insurance and ERISA plans and fiduciaries that have breached their duty and failed to pay benefits, including actions involving access to mental health benefits. One of our partners is the author of a section in a desk book on ERISA issues, a frequent speaker at continuing education classes for other attorneys and a speaker before community groups on ERISA issues.
Our representation of individuals in ERISA actions is not limited to benefit claims. We have also successfully represented beneficiaries in complex QDRO disputes under ERISA, and ERISA preemption issues.
