In August of 2019, a class action lawsuit was filed in the United States Federal District Court for the Western District of Washington against The Aliera Companies, Inc., Aliera Healthcare, Inc. and Trinity Healthshare arising out of its failure to pay benefits and issuance of unauthorized and unapproved policies in the State of Washington. In January of 2020, a second class action lawsuit was filed in the United States District Court of the District of Colorado alleging similar claims. A copy of the Complaint in the Colorado action can be viewed here.
Both actions allege that Aliera and Trinity are not legitimate “Health Care Sharing Ministries” under the law. The lawsuits allege that Aliera and Trinity made false and/or misleading claims about the plans they offered to the public in violation of each state’s consumer protection act, and denied claims that should have been approved. In addition, both actions allege that the health plans issued in the states are illegal and unauthorized.
